Message frequency varies based on your order schedule and our communications. You can expect approximately 2-5 messages per week, including order confirmations, delivery notifications, and occasional promotional messages.

3. Opt-In Process

By providing your phone number and checking the consent box on our website, you explicitly opt in to receive SMS messages from PROVENA. Consent is not a condition of purchase.

4. Opt-Out Instructions

You may unsubscribe from our SMS program at any time by replying STOP to any message you receive. You will receive a confirmation text confirming your opt-out. After that, you will no longer receive messages from this program.

DISCLAIMERS

1. Nutritional Information & Macronutrient Disclaimer

PROVENA provides nutritional information, including calorie counts and macronutrient breakdowns, as a courtesy to our clients. All such information is estimated based on standard ingredient databases, typical preparation methods, and portion sizes. Actual nutritional values may vary due to seasonal ingredient changes, supplier variations, preparation differences, and natural variations in portioning.

PROVENA does not warrant or guarantee the accuracy, completeness, or reliability of any nutritional information provided. Clients with specific dietary, medical, or health requirements should consult a qualified healthcare professional before consuming our meals. Clients are solely responsible for determining whether our meals are appropriate for their individual health needs.

2. Delivery & Timing

PROVENA uses trusted third-party couriers to deliver meals on your selected delivery days. We provide delivery windows as a courtesy and make every reasonable effort to deliver within the stated timeframe. However, delivery times are not guaranteed.

PROVENA is not responsible for delays caused by:

· Traffic, road closures, or other transportation issues
· Inclement weather or natural disasters
· Security clearances or building access restrictions
· Incorrect or incomplete delivery addresses provided by the client
· Courier errors or delays beyond our reasonable control

Risk of loss and title for all meals passes to you upon delivery to the address you provided. If you are not home to accept delivery and have authorized the courier to leave your meals, you assume full responsibility for the safety, freshness, and condition of the food from the moment it is left. We strongly recommend refrigerating all meals immediately upon delivery.

3. Cancellation & Opt-Out Policy

PROVENA operates on a recurring weekly subscription basis. To opt out of an upcoming week's delivery, you must notify us by Friday at 12 PM (local time) prior to the scheduled delivery week.

You are solely responsible for submitting your opt-out request before the deadline. PROVENA is not responsible for:

· Clients who forget to opt out by the Friday 12 PM cutoff
· Technical issues with email, text, or website forms outside our control
· Missed communications regarding your opt-out request

Once meals for the upcoming week have entered production (typically after the Friday 12 PM PST deadline), they are not eligible for cancellation, refund, or credit.

4. Health & Illness Disclaimer

PROVENA meals are prepared in kitchens that handle a wide range of ingredients, including common allergens. While we take reasonable precautions to prevent cross-contact, we cannot guarantee the complete absence of cross-contact with allergens.

By purchasing and consuming PROVENA meals, you acknowledge and agree that:

· You are voluntarily participating in dietary choices
· You assume full responsibility for any outcomes related to food consumption
· PROVENA is not liable for any illness, allergic reaction, or medical event caused by contact with or consumption of our food
· Clients with severe food allergies should consult their healthcare provider before ordering and may be advised to refrain from purchasing our products

PROVENA is a culinary service, not a medical or clinical provider. Our meals are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

5. Additional Provisions You Should Consider

a) Allergen & Dietary Restriction Disclosure

Clients are solely responsible for declaring all food allergies, intolerances, and dietary restrictions accurately prior to purchase. We will make reasonable efforts to accommodate disclosed restrictions but do not accept liability for meals prepared based on incomplete or inaccurate information.

b) Limitation of Liability

To the fullest extent permitted by law, PROVENA's total liability shall not exceed the amount paid for the specific order giving rise to the claim. We are not liable for any indirect, incidental, special, or consequential damages arising from your use of our services.

c) Menu & Ingredient Substitutions

PROVENA reserves the right to substitute ingredients or modify menu items due to availability, supply chain disruptions, or quality considerations. We will make reasonable efforts to notify clients of significant changes.

d) Food Safety & Storage

Upon delivery, the proper handling, storage, preparation, and consumption of our meals is solely your responsibility. All meals should be refrigerated immediately and consumed by the "use by" date printed on the packaging. We recommend reheating according to the instructions provided on each package for optimal results.

e) Force Majeure

PROVENA is not liable for delays, failures, or interruptions in service caused by events beyond our reasonable control, including but not limited to: natural disasters, pandemics, government actions, supply chain disruptions, labor disputes, or courier service failures.

f) No Waiver & Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision does not constitute a waiver of that right.

g) Governing Law

These Terms shall be governed by and construed in accordance with the laws of California.
